These Terms of Service govern the relationship between 0 Promil ("the Company"), operator of the 0 Promil mobile application and website (the "Platform"), and the individuals and legal entities using the services offered through it (the "User").

By registering for or using the Platform, you confirm that you have read, understood and accepted these terms. If you do not accept them, you must not use the Platform.

1. Definitions

  • Platform: The 0 Promil mobile application and the 0promil.com website.
  • User: A person who registers on the Platform and uses its services.
  • Driver: A vetted professional matched through the Platform to drive the User's vehicle.
  • Service: The intermediation through which the User's own vehicle is driven by a Driver upon request.
  • Trip: The period from the moment the Driver takes over the vehicle until it is handed back at the destination.

2. Nature and Scope of the Service

0 Promil is not a taxi, public transport or car rental service. The Company operates as an intermediary digital platform connecting Users with Drivers. The vehicle remains the property of the User throughout the Trip, and the Driver undertakes only its operation.

The Service is offered in two forms: on-demand driver requests and long-term driver hire (daily, weekly or monthly). A separate service agreement may be concluded for long-term hire.

3. Membership and Account Security

  • Only persons aged 18 or over with full legal capacity may register on the Platform.
  • The User is responsible for ensuring that the information provided at registration is accurate, current and complete.
  • The User is responsible for keeping account credentials and verification codes confidential.
  • Any unauthorised use of an account must be reported immediately to [email protected].
  • Each User may open only one account; transferring an account to third parties is prohibited.

4. User Obligations

  • The vehicle must be roadworthy, with a valid inspection and compulsory traffic insurance,
  • The documents required for the vehicle to be handed over to the Driver must be kept in the vehicle,
  • The User must treat the Driver with courtesy and refrain from any conduct that impairs safe driving,
  • No illegal substances, hazardous cargo or prohibited items may be carried in the vehicle,
  • The fare must be paid in full and on time,
  • The Platform must not be used fraudulently, abusively or in a way that disrupts the Service.

5. Driver Qualifications

Drivers on the Platform are screened through a valid driving licence check, a minimum of five years' driving experience, a criminal record check, reference verification and a face-to-face interview. Drivers also receive training in safe driving and customer communication. The Company reserves the right to suspend or terminate a Driver's activity on the Platform where it considers it necessary.

6. Pricing and Payment

  • The fee is calculated based on distance, duration, time of day and demand, and is presented to the User before the Trip begins.
  • Payments are collected solely through the Platform using a registered credit or debit card; cash is not accepted.
  • The fare is charged automatically at the end of the Trip and an e-invoice is sent to the User's registered address.
  • Differences arising from route changes, waiting time or additional requests are applied at the end of the Trip.
  • Bridge, motorway and parking charges are borne by the User.

7. Cancellation and Withdrawal

The User may cancel a request free of charge before the Driver sets off. Where a cancellation is made after the Driver has departed, a cancellation fee may be charged to cover the costs incurred. For long-term hire, cancellation and termination conditions are set out separately in the signed service agreement.

Under the Turkish Distance Contracts Regulation, there is no right of withdrawal for transport services to be performed on a specified date.

8. Liability and Insurance

Throughout the Trip, the vehicle is covered by the 0 Promil assurance policy in addition to the User's own insurance. For material damage caused by the Driver's fault, the Company accepts liability within the limits of that policy.

The Company cannot be held liable for pre-existing defects, for a vehicle condition inconsistent with the User's declaration, for force majeure, or for damage caused by the fault of third parties. The Company is not responsible for items left in the vehicle, although our support team will endeavour to return any items found.

9. Suspension and Termination

The Company may suspend or terminate a User's account without prior notice in the event of a breach of these terms, submission of false information, failure to meet payment obligations, or conduct threatening the safety of a Driver. The User may likewise terminate the agreement at any time by deleting their account.

10. Intellectual Property

All software, design, trademarks, logos, text and imagery on the Platform belong to 0 Promil or are used under licence. Copying, reproducing, distributing or commercially exploiting these elements without permission is prohibited.

11. Protection of Personal Data

The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these terms.

12. Amendments

The Company reserves the right to update these Terms of Service unilaterally. Updates take effect upon publication on the Platform; material changes are additionally notified to Users.

13. Governing Law and Disputes

These terms are governed by the laws of the Republic of Türkiye. The parties shall first seek an amicable resolution of any dispute. Failing that, the Consumer Arbitration Committees within the applicable monetary thresholds, and the courts and enforcement offices of the Republic of Türkiye, shall have jurisdiction.
